Verification and Scope of Use

Strategic initiatives, long and short term planning and new product or service initiatives are a significant component of the successful multi-national company’s vision. Throughout the world there are similar uses of names, domains or other descriptors in existence which could deter or otherwise impact the desired use by a client for a future product or service. Therefore, it is very beneficial to be able to accurately verify and qualify any apparent use to assess the client’s likelihood of prevailing in an effort to secure the rights desired before investing heavily in a marketing or advertising campaign.

Similarly, scope, use and the substantive worth of an infringer may have a very significant impact on the determination of the proper remedy to protect a client’s IP rights. Investing heavily in an elaborate litigation strategy against an infringer with little or no net worth may not be the best solution, as that knowledge can only be determined with certainty through proper research and investigation.
