Trade Secrets

Trade secrets for many years have been protected only by state laws which were patterned after the Uniform Trade Secrets Act. However, Congress enacted The Economic Espionage Act of 1996, which criminalized the theft of trade secrets when the theft is made with the intention of benefiting a foreign government, instrumentally or agent 18 U.S.C. §1831 or a common commercial theft of trade secrets regardless of who benefits. The Economic Espionage Act also protects the confidentiality of trade secrets during litigation. Both civil and criminal remedies are available.

Companies are often a victim of compromised trade secrets by employees or individuals focused on establishing a competing business. However, they can also be the target of aggressive competitive intelligence gathering efforts by foreign governments that are likely to benefit from the theft of research and development investments.
