Intellectual Property (“IP”) specifically refers to intangible assets which are legally protected in some manner and degree. Protection can take varying forms, depending on the jurisdiction, and includes patents, copyrights, trademarks and trade secrets.

Trademarks, patents and other forms of intellectual property protection have become products unto themselves; capable of producing revenue streams and competitive advantages.

Intellectual property protection is so much a part of global business, no organization can afford to ignore the fiscal responsibility these intangible assets impose. The cost of failing to manage IP is not only lost revenue but the potential loss of future rights as well.

Managing IP effectively requires a wide range of legal, financial, corporate and investigative capabilities, drawn together by a strategy which is aligned with the organization’s overall goals. One challenge is that the value of an intangible asset is not fixed. The value of the intangible asset is constantly changing, based on market conditions and in concert with business strategy. Unless enforcement of intellectual property rights is made a corporate wide strategic consideration and tied to strategy and goals, IP management can sink to defensive monitoring and prosecution, rather than preferred creative initiatives to boost return on investment.

Developing a strategic approach to intellectual property management enables an organization to make the best decisions regarding intangible asset utilization. Strategic IP management requires a primary focus on the “upstream” activities which drive value creation. If an organization does not actively work on intellectual property protection, they are certainly wasting money and time. Effective IP management generates additional revenue and ultimately, enhances shareholder value. With any intellectual property protection and management, the key is to take a systematic approach, with centralized responsibilities, accountability and performance requirements.
